- AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are FINAL AND BINDING in all respects. Winning a prize is contingent upon fulfilling all requirements set forth herein.
- ELIGIBILITY:Sweepstakes is open to legal residents of the contiguous United States or the District of Columbia, who are 21 years of age or older as of date of entry. Employees, owners, shareholders, officers and directors of Sponsor, and each of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives, prize providers, promotion and advertising agencies (collectively, the “Sweepstakes Entities”) together with the Immediate Family Members and/or Household Members of such persons, are not eligible to participate in the Sweepstakes. For purposes of the Sweepstakes “Household Members” shall mean those people who share the same residence at least three months a year; “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. - HOW TO ENTER:To enter the Sweepstakes, visit bravamagazine.com and complete the Sweepstakes entry form, completing all required fields. Only entries submitted via this method are eligible. Entries submitted via any other method, will NOT be accepted. All Entries must be received by the close of the Sweepstakes Period. Limit one (1) entry per person. An Entry or Entrant may be disqualified, at the Sponsor’s sole discretion. Entries generated by a script, macro or other automated means will be disqualified. Entrants must accurately provide all of the requested information to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. Participation in the Sweepstakes constitutes Entrant’s understanding of, full and unconditional agreement to, and acceptance of these Official Rules. - WINNER SELECTION AND NOTIFICATION: One (1) winner will be selected in a random drawing on or about September 10, 2024 among all eligible entries received. Winner(s) will be contacted by Sponsor by phone and/or email listed in the entry form and will have 48 hours to contact us to claim their prize. If the winner fails to contact us within 48 hours, they will forfeit the prize and a new winner will be randomly chosen. The Sponsor is not responsible for any misdirected or unreceived notifications. The potential winner will be required to respond (as directed) to the notification within three (3) days (or a shorter time if required by exigencies) of attempted notification. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of the prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. The Sandals Prize must be accepted as awarded, and prize is awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. No redemption for cash, substitution, assignment or transfer of a prize is permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value, in the event of unavailability of the advertised prize. - CONDITIONS OF PARTICIPATION/RELEASES:All federal, state, and local laws and regulations apply. - GOVERNING LAW/ DISPUTES:This Sweepstakes is governed by the laws of the United States and the State of Wisconsin, without respect to any choice of law or conflict of law principles that would result in the application of any law other than that of California. As a condition of participating in this Sweepstakes, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually through binding arbitration, without resort to any form of class action, in accordance with the arbitration provision set forth below.
- ARBITRATION PROVISION:By participating in this Sweepstakes, each Entrant agrees that any and all disputes the entrant may have with, or claims Entrant may have against, the Released Parties relating to, arising out of or connected in any way with (i) the Sweepstakes, (ii) the awarding or redemption of any prize, and/or (iii) the determination of the scope or applicability of this agreement to arbitrate, will be resolved individually and exclusively by final and binding arbitration administered by the National Arbitration Forum (the “Forum”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the Forum. The arbitration shall be held at a location determined by the Forum pursuant to the Code of Procedure, or at such other location as may be mutually agreed upon by the participant and Sponsor. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules and any of the other agreements referenced herein that the applicable participant may have entered into in connection with the Sweepstakes. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the participant’s and/or Sponsor’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated. The arbitrator shall not have the power to award special or punitive damages against the participant or Released Parties. - Additional Sandals Prize – Terms and Conditions
- Sandals Resorts is an all-inclusive Caribbean Resort for adults only.
- The Sandals Prize will include luxurious accommodations (one (1) room, double occupancy in a deluxe/luxury category room), all meals, unlimited Premium Liquors, daily & nightly entertainment, an array of land and water sports activities, including daily Scuba diving (for certified divers), snorkeling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes, and Sandals transfers to and from the selected or designated airport.
- “Exclusions” – airfare, car rental, personal charges, incidentals, telephone calls, Premium Wi-Fi, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, room services, meals outside of the selected or designated resort, island departure taxes, purchases made at the Sandals Specialty or Gift Shops, baggage fees, customs duties, and travel insurance are not included.
- The Sandals Prize will be issued in the form of a prize certificate (“Prize Certificate”) outlining the terms and conditions of the prize and redemption procedures.
- The Sandals Prize must be redeemed for travel within one (1) year from the date on the Prize Certificate (the “Redemption Period”) and is not transferable or redeemable for cash. No extension will be given after the Redemption Period has expired. If the Sandals Prize is not redeemed, the Sandals prize will be forfeited.
- The Sandals Prize is subject to space availability and selected blackout dates. Reservations will not be confirmed until 30 days prior to the selected travel date. Confirmation of travel dates will only be provided 30 days prior to the departure date.
- Any federal, state and/or local taxes applicable to the Sandals Prize will be the prizewinner’s responsibility to pay. The Prizewinner will receive from Nei-Turner Media Group, Inc. or its designee an IRS Form 1099 (or similar) in the amount of the Sandals Prize.
- Substitution of Resort: Unique Travel Corp – the Sandals Prize Provider and/or Sandals Resorts each reserves the right to substitute the selected resort for another resort in the resort’s chain in a similar category, and to change dates without prior notice for any circumstance(s) beyond the resort’s control based upon availability for the secured travel dates. The terms and conditions agreed to shall apply with equal applicability to any resort which is the subject of substitution or deviation. Neither Unique Travel Corp nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.
- Compliance with Government Entities. Unique Travel Corp, its affiliates, and parent as well as Sandals Resorts and/or Sandals Resorts related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of the Agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.
- Health and Safety: Sandals Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.
- CLASS ACTION WAIVER: ACCEPTANANCE OF THE SANDALS PRIZE PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT AS A RESULT OF THIS AGREEMENT.
